General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (hereinafter referred to as "GTC") govern the contractual relationship between 1a Visum Service oHG (hereinafter referred to as "Service Provider") and the customer (hereinafter referred to as "Customer"). These GTC apply exclusively to all services offered on the website cuba-visa-express.com.

2. Service Description & Disclaimer

The Service Provider acts as a private commercial agency that processes visa applications (Tourist Cards) for Cuba on behalf of the Customer. We are explicitly not an embassy, consulate, or government agency. By using our service, the Customer commissions us to procure the visa code (Tourist Card) from the relevant authorities or authorized distributors. The price charged includes the official consular fees as well as our service fee for express processing, system maintenance, and 24/7 support.

3. Conclusion of Contract

The contract is concluded when the Customer completes the online application form and effects payment. The Service Provider immediately commences the execution of the order (generation of the Visa Code). The Customer expressly agrees that the service execution begins before the expiry of the statutory cancellation period.

4. Right of Withdrawal & Cancellation Policy

Exclusion of the Right of Withdrawal: Pursuant to § 312g para. 2 No. 1 BGB (German Civil Code) and equivalent EU consumer directives, the right of withdrawal does not apply to contracts for the provision of services if the contract has been fully performed by the trader.
Since the "Cuba Visa Code" is a digital product that is generated and delivered immediately or processed instantly upon payment, the Customer expressly waives their right of withdrawal by placing the order. Refund requests based on "change of mind" or "travel cancellation" cannot be honored once the code has been generated.

5. Processing & Delivery

The Visa Code is generally delivered via email within minutes of successful payment. The Service Provider is not liable for delivery delays caused by technical failures of the internet, the Customer's email provider (e.g., spam folder filtering), or force majeure. The Customer is responsible for providing a correct email address.

6. Liability & Visa Issuance

The Service Provider guarantees the proper forwarding of the application data to the issuing systems. However, we assume no liability for the actual entry permission granted by the Cuban authorities. The final decision on entry into Cuba lies solely with the border control authorities.
The Service Provider is not liable for:

• Rejection of entry by Cuban officials.
• Errors in the data provided by the Customer (e.g., typos in passport numbers).
• Changes in travel regulations after the visa has been issued.
• Flight cancellations or travel disruptions.

7. 100% Refund Guarantee (Rejection Only)

We offer a voluntary "100% Money-Back Guarantee" solely in the specific case where a visa application is officially rejected by the Cuban government or the issuing system due to reasons not attributable to the Customer. This guarantee does not apply to traveler cancellations, incorrect data entry by the Customer, or duplicate applications.

8. Data Protection

The Customer's personal data is processed solely for the purpose of visa procurement in accordance with the GDPR (DSGVO). Data is transmitted securely via SSL encryption. Further details can be found in our Privacy Policy.

9. Final Provisions

The law of the Federal Republic of Germany applies. The place of jurisdiction is the registered office of 1a Visum Service oHG (Berlin), to the extent legally permissible. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
